Medical Negligence vs Medical Malpractice: What's The Difference?

Medical malpractice and medical negligence are terms that are frequently used interchangeably, but it is important to understand that they refer to two distinct legal concepts.

Medical malpractice is a type of personal injury lawsuit wherein a physician or other health care professional is held liable for damages and/or injuries that they caused to a patient. In most medical malpractice cases, the cause of the injury is often attributed to medical negligence.

While almost every medical malpractice case has it's basis in some form of medical negligence, a negligent act, in and of itself, is not sufficient grounds for bringing a medical malpractice claim.

To better understand this concept and the difference between these two terms, we can use another familiar type of personal injury claim, a car accident, as an example. Car accidents can be caused by a negligent driver running a stop light and crashing into a vehicle that had the right of way. In this case, the negligent driver could be sued in court and held liable for all damages and injuries that were caused by his negligent actions that caused the accident.

If that same driver runs another stop light the following week, but doesn't hit anyone or cause another accident, there are no grounds for a lawsuit. You cannot file a lawsuit against someone unless their negligence actually caused you injury. While that driver may receive a traffic citation, have his license suspended or revoked and be otherwise punished in criminal court, civil court deals only in compensation for actual injuries received as a result of the negligent actions of others.

Likewise, if your physician acted in a negligent manner, but that negligence did not result in an injury or any actual damages, that doctor may be punished or even lose his license or certification if the infraction was serious enough and was reported to the proper medical authorities, but the negligent act, in and of itself, is not sufficient grounds for a medical malpractice claim because the doctor's negligent actions didn't actually injure anyone.
